Understanding Bodily Injury Claims in Las Vegas

If someone sustains an injury due to someone else’s actions, the person who may have caused the injury may be liable.

The affected party then may be able to file a personal injury claim. These cases often involve:

  • insurance companies
  • medical records
  • fault disputes

It’s important to keep in mind that Nevada law controls how claims are filed and how compensation is handled.

What Is a Bodily Injury Claim?

A bodily injury claim is a personal injury claim based on an injury you sustained. Common examples include:

  • fractures
  • burns
  • internal injuries

To bring a claim, four things must exist:

  • A duty of care
  • A breach of that duty
  • A link between the act and the injury
  • Actual damages

These claims often happen after car crashes, falls, or unsafe products.

Personal injury claims often involve negligence. To determine if someone’s actions were negligent, courts often determine whether the person failed to act reasonably to prevent the injury by acting more carefully under the same conditions.

Common Causes of Bodily Injury Accidents

Injuries can happen in many ways. Here are some ways where someone’s negligence may lead to a personal injury claim:

  • Car and truck accidents
  • Pedestrian incidents
  • Falls
  • Workplace accidents

These are just a few, but injuries happen from all different kinds of incidents.

Common Types of Serious Injuries

Serious injuries can change someone’s daily life. Some common injuries that really can complicate someone’s day include:

Catastrophic Injury – These are generally severe, life-altering injuries. This can include: spinal cord damage, traumatic brain injuries (TBIs), amputations and severe burns.

Brain Injury – Damage to the brain that disrupts its ability to function normally.

Spinal Cord Injury – This is damage to the spinal cord or to the nerves at the end of the spinal canal. This kind of damage can disrupt the transmission of signals from the brain to the rest of the body.

Burn Injury – Burn injuries involve damage to the skin. Some go deeper depending on the source, such as heat, chemicals, or electricity.

Back Injury – This is generally an injury to muscles or discs. Injuries like this can limit a person’s ability to move.

Amputation – This is when loss of a limb occurs.

Broken Bone Injury – When force is strong enough, a bone can crack or break. This is known as a broken bone injury.

Neck Injury – The neck contains muscles, ligaments, and discs that can be damaged. This can affect motion or cause pain.

Bone Fracture – This is when a bone cracks or breaks.

Paralysis – Loss of movement in part of the body is known as paralysis. It often involves nerve or spinal cord damage.

Whiplash – Whiplash is a neck injury. It happens when the head moves quickly back and forth.

Head Injury – Head injuries involve damage to the head caused by impact. Injury to the head may affect how the body functions.

Nerve Damage Injury – Damage to nerves can cause numbness, pain, or loss of function. The effects are not always the same patient to patient.

Eye Injury – An eye injury is damage to the eye or surrounding area. It can impact vision.

Laceration Injury – A laceration is a deep cut or tear in the skin or tissue. It is usually caused by a sharp object.

Some of these injuries require long-term care. Just think about it, if you had a hurt neck that could impact your life in so many ways from the ability to sleep, to participating in your favorite activities, not to mention the pain you experience daily.

According to the American Association for the Surgery of Trauma (AAST), every year in the U.S, over 3 million people sustain serious non-fatal injuries.

Who May Be Liable for an Injury?

In an injury lawsuit, who is liable depends on who caused the harm. In some cases, more than one party may be responsible.

This section takes a look at some of the more common parties that cause physical injuries to others.

Negligent Drivers

Car accidents are a large source of injuries. Drivers whose actions may contribute to accidents and injuries may be responsible for:

  • Speeding
  • Distracted driving
  • Driving under the influence

Property Owners or Businesses

In Nevada, property owners have a duty to keep their property safe. Think places like hotels, casinos, and stores. Here are some examples of factors that may lead to injuries:

  • Slippery floors
  • Poor lighting
  • Unsafe walkways

Employers or Other Parties

Employers may be deemed responsible for injuries that happen at work. Work injuries may involve:

  • Employers
  • Contractors
  • Equipment manufacturers

Compensation Available in an Injury Case

Settlement Disclaimer: Past results do not guarantee future outcomes. Each case is unique, and compensation depends on individual circumstances.

In an injury lawsuit, the affected party may be able to pursue compensation. Compensation depends on the injury and its impact.

There are several different types of compensation that may be available depending on the facts of the case.

Economic Damages – These are losses tied to a measurable monetary amount. They may be medical related expenses, damage to property or related to loss of income.

Non-Economic Damages – These losses are not tied directly to a measurable amount of money and are harder to calculate. They include things like pain and suffering and changes to quality of life.

Wrongful Death – The surviving relatives of someone killed by negligence may be able to sue. They may seek compensation for costs such as funeral related expenses, loss of companionship or income and more.

Punitive Damages – These are very rare and are damages awarded to punish especially bad behavior. This is usually when the damage caused was not just out of pure negligence but out of disregard. Think drunk driving or repeat offenses.
